Ben Martin Law Group Trial Lawyers Earn Top Verdict Honors for 2021 IVC Filter Litigation

Dallas trial firm stands out for successes in medical device defect litigation

 DALLAS – A $2.549 million jury verdict over a defective medical device secured by Ben Martin Law Group has been recognized as one of the state’s top 100 verdicts for 2021, according to an analysis by Texas Lawyer magazine and VerdictSearch.

The May 2021 verdict in Dallas federal court was the fourth-largest product defect verdict and the 51st largest overall in Texas. It was one of four similar trial victories by Dallas-based Ben Martin Law Group during a nine-week period between May and June 2021 during the height of COVID-19 restrictions.

Firm founder Ben Martin was lead counsel in the Dallas case, which focused on claims that defective IVC filters caused medical complications and injuries after they were implanted. The filters are inserted into a major vein, the inferior vena cava (IVC), to prevent blood clots from moving to the heart and lungs.

The firm’s performance in 2021 solidified its national reputation for prevailing in complicated litigation involving dangerous products, mass torts and catastrophic personal injury claims.

In 2019, Mr. Martin was lead counsel in the bellwether case filed in the multidistrict litigation over Cook Medical’s IVC filter. The $3 million verdict in that case marked the first-ever design defect finding by a jury in an IVC filter case and was the largest actual damages verdict in an IVC filter case. That record verdict has since been surpassed by a $3.3 million verdict in another IVC filter case tried by the firm in federal court in Madison, Wisconsin.
